これまでの研究成果をふまえて、本年度は四季法廷大陪審員の出身教区内における社会的・経済的地位や活動の検討を主な課題とした。いくつかの教区の事例研究からは、大陪審員の多くが教区運営の中枢を担う社会層から任命されていたこと、またその大半がある程度の土地を所有し、経済的にも教区民の中流以上に位置したことが確認できた。このように近隣共同体において「有為の実力者」と認められた人々が大陪審の中核をなしたことは、この制度を成立、機能させていく上での重要な基盤であったといえる。他方で大陪審は、教区税を負担しない住民と治安判事のあいだに位置する幅広いグラデーションを含んでいた。対象地域におけるこの「中間の人々」の多層性は、大陪審制運営の不安定要素ともなる。とくに世紀後半にかけて出身階層の凝集性が薄まる傾向が認められたが、この変化は大陪審員の選任方法の改善をめざした議会法制定の動きとも呼応する。1696年にはヨークシャ大陪審員の財産資格の見直しと召還人数の大幅な削減が議会法により定められ、ノースライディング四季法廷大陪審員の選任パターンの一大転機となった。本研究において検証された大陪審員選任の実態は、任命・被任命側の双方にある諸制約と受動的・能動的選択の帰結としてとらえられる。大陪審制は、その責務を受け入れた地域住民を権力の行使に参与させることにより秩序維持をめざした。これは同時に地域住民に「国家を経験させる」ことを意味し、彼らを統治システムのエージェントとして国家に包摂する場として機能した。この権力リソースへのアクセスは大規模かつ定期的に与えられる一方で、治安判事の監督下に暫定的にのみ認められるものであった。大陪審員と上位権力の関係に浮き彫りにされる対立と協力、信頼と懐疑の不安定な均衡は、近世イングランドにおける国家の発達と地域秩序の維持形成を包括的に理解する重要な鍵となるだろう。

The relationship between the grand jury and the superior power is a key to understanding the relationship between the state and the maintenance of regional order, including coordination, trust, uncertainty, equilibrium, and modern times.
