本研究は,民事訴訟における真実発見の価値と費用を特定し,それを比較した上で好ましい解釈論・立法論を展開することを目的とするところ,菱田「知財訴訟における証拠法の課題」では,真実発見の要請と秘密漏洩による不利益とが緊張関係に立つ知的財産訴訟において,その合理的な調整方法について検討した。現行法は秘密保持命令を導入することによって,一定の調整を図っているが,秘密保持命令を受けて秘密に接することができる人的範囲について利害関係人間で見解が一致しない場合についての調整の仕組みを欠いており,立法的な対処が必要であることを指摘した。菱田「独立当事者参加について」は,誤判によって特定の第三者が不利益を被る可能性があるという領域について検討した。かかる場合には,多少の費用の増加を甘受してでも,当該第三者に主体的に訴訟追行する権能が広範に認められるべきこと,他方で,当事者の側にも第三者の不当な介入から自己防衛する権能が認められなけれぱ,参加の費用は過大になることを主張した。菱田「消費者団体訴訟の課題」では,誤判が不特定多数の第三者に不利益を及ぼす局面を検討した。具体的には,ある適格消費者団体の訴訟追行による誤判によって消費者全体が不利益を受けるという局面である。かかる場合には個々の消費者の主体的な防衛は期待できないので,他の適格消費者団体との関係を論じることになる。複数の消費者団体が同一の事項について同一事業者に対して訴えを提起した場合,それらの訴えを類似必要的共同訴訟として理解することも一考に値すること,かかる前提に立った場合には,訴外適格消費者団体の参加は,共同訴訟参加として把握する可能性も生じることを指摘した。

This study focuses on the value and cost of civil litigation, and discusses the reasonable adjustment method of property litigation.
