本年度においては、まず、「公共哲学」を、集合的・公共的利益の維持に対する私法上の権利の思想的・哲学的な基礎とする可能性について考察を加えた。「公共哲学」では、「公」と「私」とを媒介する第三項として「公共性」を捉え直すというモデルが提示され、この論理は「公私共媒・活私開公」と表現されている。また、公共哲学においては、この論理を基礎として、「公共性」の概念、人間像、そして思考方法が、それぞれ提示されている。このような内容を持つ公共哲学における「公共性」および「活私」という概念を思想的・哲学的な基礎として、集合的・公共的利益についての規範の形成に対する私法上の権利、および集合的・公共的利益についての規範の維持に対する私法上の権利が認められうる、との結論を導き出した。このような私法上の権利の目的となる集合的・公共的利益は、(1)広中俊雄の示す市民社会論において認められている「競争秩序」または「生活利益秩序」に含まれると考えられる集合的・公共的利益に限定される。また、「公共性」および「活私」という概念を基礎として私法上の権利を認める場合には、(2)「公共性」を基礎とする民法上の集合的・公共的利益とは、当該集合的・公共的利益から一定の市民に対して個別に利益が割り当てられている、という意味において市民個人の私的利益の個別性が維持されているという性質を持つ集合的・公共的利益であること、(3)私人に、「公共性」を基礎とする集合的・公共的利益についての規範に関して一定の活動を行う地位としての私法上の権利を認めるにあたっては、当該私人が、当該集合的・公共的利益に含まれている個別の利益を保持していること、(4)「公共性」を基礎とする集合的・公共的利益に対する規範に関して一定の活動を行う地位としての私法上の権利を認められる私人は、当該集合的・公共的利益に対する規範を自らも遵守していること、もそれぞれ求められる。このような公共哲学を基礎とする集合的・公共的利益についての規範の維持に対する私法上の権利に関して、さらに、現在、私法学において示されている債権及び物権の法的構成を基礎におき、それぞれで示されている内容との比較のもとにその構造を考察するという方法を通じて、その構造についての私見を導き出した。以上のような本研究の詳細については、次年度以降に研究論文として公表する予定である。
