明治日本の条約改正史は、幕末に日本が西洋諸国と締結した修好通商条約中の不平等な条項、特に領事裁判権の規定と関税自主権の喪失、を撤廃する交渉過程としてイメージされて来た。しかしこれらの条項が日本の国家形成にとってどれほどの阻害要因であったかが明確ではなかったため、条約改正史を日本の近代史の中にどう位置づけるかは未決の問題であった。本研究によってまず明らかとなったのは、日本政府に一貫して問題視されていたのが、日常的な個別の行政活動に対する外国側の介入であったということである。この介入は条約には明記されていないまま既成事実化した外国側の特権であった。日本の国家形成は立法・司法と未分離な状態で行政を中心に進展しており、だからこそ政府は行政権への介入に最大の痛痒を感じたのである。さらに本研究では、こうした知見を元に、条約改正史全体の再構成を試みた。1880年代初頭までの条約改正交渉は、まさに行政権への介入を撤廃させることを企図したものであった。条約の改正よりは、適正な運用をむしろ求めたものといえよう。これが外国側の抵抗によって難航し、かつ司法が一定の発達を見た80年代後半、井上馨外務卿は一挙に領事裁判権の撤廃を求める方針に転換する。しかし行政の独立という課題も政府内外に継承されていく。第一に、大蔵省・農商務省といった個別官庁が、自らの管轄する行政領域の対外独立への目配りが弱いとして井上・大隈重信外相期の外務省案に懐疑的な立場をとった。そのため条約改正交渉に対する政府内部の支持は脆弱であった。第二に、在野勢力は条約の適正な運用によって外国の既得権益を剥奪することで有利な条約改正交渉が行えると主張し、いわゆる条約励行運動によって陸奥宗光外相期の政府を窮地に立たせたのである。以上のようにして、条約改正史を近代政治外交史の中核に位置づけ直すことができたと考える。
