本研究は、子どもの権利論の観点からその法的問題点を分析するとともに、よりよい法的枠組み、処遇のあり方をもとめて、アメリカ合衆国の法と実務を模範として比較法研究を行った。その結果、わが国で言う触法少年については、適正手続保障の観点からすると児童福祉手続ではなく、少年司法手続で扱うことの方が、当該少年の成長発達の簡単からも少年自身の納得を得られやすいこと、処遇においては、民営施設による教育プログラムの利用が重要であると結論づけた。
