项目摘要

本年度は、アメリカ環境法制のマグナカルタと称されるNEPA(1969年国家環境政策法)を中心とする省庁間政策調整の仕組みに関する理論・実証研究を継続し、とくに、CAA(大気清浄法)309条に基づく環境審査制度について、その実施機関であるEPAの(開発系省庁に対する)調整機能を考察した。その結果、行政学における「紛争マネジメント」の概念の上に、複数の制定法(NEPAとCAA)に基づく複数の機関(EPAとCEQ)の有機的な連関(調整)という法システムの存在が、アメリカ環境法制における省庁間政策調整の平面で浮かび上がってきた。すなわち、NEPAの執行機関であるCEQ(環境諮問委員会)の調整機能、CAA(大気清浄法)309条に基づく環境審査制度の基本構造、EPA(環境保護庁)の牽制・調整担当部門の機能など、重層的な構成要素からなる仕組みが存在し、それら主要構成要素間の有機的な連携の確保がかかる仕組みの実効性を担保しているという確信を得ることができた。この確信は同時に、この連携を確保する基本思考なるものを解明し、当該仕組みを全体として一つの法システム(NEPAシステム)として捉え、提示することが今後の研究課題となることを示している。また、近年の各種の行政基準の発達や1998年に新たに設置された法定の調整機関の機能等、これまでの研究で考察できていない主要構成要素についても、新たな理論・実証分析を施すことが必要となることもまた明らかにされた。
