本研究の最終年にあたる平成19年度は、夏にオランダ・ライデン大学図書館に赴いて史料調査を行うともに、この3年間の研究成果をまとめ上げ、広く公表する作業に従事した。本研究を通じて、大きく二つの成果を残すことができた。一つ目としては、西周と津田真道が幕末オランダ留学を通じて導入したフィッセリング「万国公法」の世界に光をあて、日本の近代国家形成黎明期に国際法受容という政治課題が根源的に抱えた思想的諸問題を解明した。特に、幕末期に広く受容された『恵頓撰、丁?良訳 万国公法』との比較を通じて、同書が普遍的な法規範の存在を唱えるのに対し、フィッセリング講義では、むしろ万国公法とは西洋諸国の歴史のもとに作り出されたものとみなされ、何よりも文明国としての交際・交易が重視されていること、それ故に文明国と非開化国、西洋諸国と非西洋諸国との問では主権の在り方は非対称的であると定められていることを明らかにした。その上でこの二つの万国公法論が、当時の日本の対西洋・対東アジア外交政策にいかなる影響を与えたのか、分析した。その成果については、2007年12月に国際高等研究所において開催された「19世紀東アジアにおける国際秩序観の比較研究」をめぐる研究会(代表者 吉田忠・東北大学名誉教授)に招聘され、「幕末オランダ留学生におけるヨーロッパ法学受容と『万国公法』」という研究発表を行った。また二つ目の成果として、西周らによるオランダ法学受容が、その後の日本政治思想史の展開にいかなる影響を与えたのかという観点から、小野梓の営為を取り上げ、彼がオランダのローマ法学者、ハウドスミットの著作を通じて、西洋法学の淵源へと溯るとともに、日本の法的伝統を根底から捉え直し、近代国家建設に向けた「法典編纂」へと取り組んだ軌跡を描き出した。この成果は、論文「小野梓におけるローマ法学と功利主義」(上)(下)としてまとめた。
