项目摘要

本研究は、2004年に行われた行政事件訴訟制度改革に対して、理論的側面及び実際的側面から検証を加えた。理論的側面からの検証の主たる成果として、原告適格、義務付け訴訟、差止訴訟を中心に、その理論的基礎及び法的問題点等を明らかにした。かかる理論的側面からの検証の成果を前提として、主として2004年改正後に出された裁判例の分析を行い、処分性、原告適格、義務付け訴訟を中心に、制度改革による実際的影響を明らかにした。

This study is based on the reform of administrative litigation system in 2004, the theoretical basis and the practical basis. The theoretical basis, main results, plaintiff qualification, obligation to pay litigation, difference litigation center, theoretical basis and legal problems are clearly stated. On the basis of the theory, the results of the examination, the premise, the main point and the analysis of the judgment cases after the correction in 2004, the dispositions, the plaintiff's eligibility, the obligation to pay, the center of litigation, the influence of the system reform, etc.
