本年度の研究に於いては、昨年度の思想史的方法とは対照的に、現代分析法学的法実証主義の一類型としての法命令説について主として検討を加えた。特に法的判断の持つ規範性の説明として、道徳判断が持つと一般に考えられている規節性の説明としてのメタ倫理学説とその法概念論的類比に着目して、検討を行った。この作業の結果として、いわゆる典型的な道徳実在論と典型的な道徳反実在論の中間形態としての実在論的表出主義や折衷的表出主義などの立場が検討され、これらが法概念論上に重要な応用を持つことが確認された。特にその表出主義的側面に基づいて、法的推論の持つ意味論的性質や法的議論に於ける不同意(disagreement)の持つ性質が明らかになることが期待できることも確認された。これらの純粋に法概念論的な成果に加え、これと並行して基礎となるべき政治哲学としての功利主義について更なる検討を加えこれを自著『統治と功利』として勁草書房より上梓した。また、上述の法概念論的成果を、自著に於いてその一部分ながら公表することが出来たし、そこに於いて規範的法実証主義的法命令説の形而上学的基礎を多少なりとも明らかにした。また、ホッブズ的命令説とベンタム的命令説の差異という古典的問題をやや迂説的な形ながら、ハイエクの社会哲学との関係に於いて陰伏的に検討するという試みを『春秋』誌上掲載の小論「ハイエクに覆いかぶさる設計主義の影」に於いて行った。これらと並行して昨年度以来継続している思想史的アプローチとしてはベンタムの関連する著作の検討を初め、法概念論上の主著『法一般論Of Laws in General』の精確な読解と把握を対象として引き続き多くの作業を行った。この過程では『法一般論』の日本語訳を基に東京大学でのベンタム研究会に於いて他の若手ベンタム研究者との共同的検討が行われた。

This paper discusses the relationship between the two theories and the main work of "General Theory Of Laws in General". This process is based on the Japanese language of "general theory of law" and is discussed by some researchers at the University of Tokyo.
