戦国期中国・北九州地方を中心とする、旧大内・毛利・大友支配領域に於いて、主人の「勘気」に対する処罰規定を見るに、共通して以下の事象が指摘され得る。即ち、第一に、これ等の大名権力に於いては、旧来の、忠功に基づく「勘気」宥免措置が否定された事。第二に、「勘気」処罰が、罪の軽重と言う、「理非」に基づくものとされた事。即ち、「勘気」処罰の判断過程が、法の判断過程に類似するようになった事。第三に、これ等の変化の際、そこで使用された理論は、当該地域の同時代に於ける、主従制に関する幾つかの規範ないし規範意識を活用、若しくは換骨奪胎して形成された事。以上である。これ等の事象は、何れも軍事制度の形成や再編と連動している。即ち、具体的には、戦国期動乱の激化に伴い、由緒由来、格式、忠の浅深を全く異にする雑多な戦闘員を家臣として採用した結果、家臣団としての一体性を確保する必要が生じ、「御家人」「家人」などの法的に平準化された身分を作る必要が在った。そこで忠功の如何によらない「勘気」処罰が企図されたのである。無論、この事は、旧来の家臣の特権のひとつである、忠功に基づく「勘気」処罰宥免を否定する訳だから、あくまでも、彼らの規範意識に依った形でなければならなかった。だからこそ、旧来の規範意識の活用、換骨奪胎と言う形式で変化が齎されたのである。この過程に於ける副産物として、互酬性一般とは断絶した、刑事責任が発生したことが挙げられる。即ち、忠功と賞罰の相殺という互酬性に基づく刑事賞罰原理が意図的に否定され、近世的な、「行為を為した事への非難」という、「公儀」の立場からする刑事処罰原理が選択された事を意味する。
