今年度は昨年度着目した西大寺衆徒掟書の周辺事情を探るべく西大寺文書の写真帳等を探究した。然し、捗々しい結果が得られなかった為、敢えて迂路を採る事とし、南北朝から室町時代に掛けての武家裁許状に現れる、不法行為責任処罰事例を蒐集した。但し此の試みは史料が余りに簡潔である為、分析が思う様に捗らなかった。其処で、左様な簡潔な裁許状が当該期に多く出される所以を考察する事にした。鎌倉幕府裁許状に就いては、初期の「事実者」裁許状時代を除き、概ね三者対面の上、原被両造の主張及びそれに対する裁判所の判断を詳細に記した形式が主流である。然し、南北朝期以降に成ると、原告の主張のみを以て判決する、所謂「一方向」裁許状(欠席裁判の裁許状)が主流と成る。私は、其の背景には、被告を敢えて明示せず、「甲申丙事」の事書を採択する事で、飽く迄も「丙」なる事実に関する裁許を行い、第三者効を拡大する意図が有ったのでは無いか、と云う仮説を立てた。此の検証の為に、先行する鎌倉幕府時代に於ける裁許の既判力如何を調査した。現在、完全な調査には至って居ないが、鎌倉期の裁許には、二当事者間を超えた効果は存在しなかった者と推測される。猶、前年度に引き続き、史学史の研究も行った。今年度は、南北朝正閏問題に関する論争を読み解き、当時の歴史学者が、歴史「解釈」の有する規範性に充分自覚的でなかった点を明らかにした。此の点で、論争から二世代後の平泉澄は例外的な存在であったと云い得る。
