项目摘要

最終年度となる平成21年度は,交付申請書に記載した研究実施計画にしたがって,知的財産権制度について情報正義論の視角から研究を行うとともに,これまで取り組んできた知的財産権の原理的考察が現代の政策的課題の解決においてどのような意義を持ちうるのかを探求することに時間を費やした。そして博士論文の完成に向けて全力を尽くした結果,当初の予定より早く,2009年9月末に所属大学の法学研究科に博士論文『知的財産権の正当化根拠論の現代的意義』を提出し,同年12月末に博士号を取得することができた。本年度の研究成果である博士論文の概要は次のとおりである。第I部では,考察の出発点として,知的財産権の正当化根拠をめぐる議論を検討した。その際,正当化根拠論の分析視角を得るために,他者の自由を制約するという知的財産権の性質に着目した。次に第II部では,近年の国際的および国内的な知的財産法政策の動向を検討した。具体的には,情報正義論から明らかとなる知的財産権制度内の「自由の砦」に着目しながら,TRIPs協定の成立を契機として自由規制領域が拡大している現状を浮き彫りにし,その要因を分析した。そして第III部では,主に我が国の著作権保護期間延長問題や米国のパテント・リフォーム論議を手がかりとしながら,知的財産法政策形成過程における正当化根拠論の意義を探求した。知的財産権の正当化根拠論は,政治的な影響力や経路依存性に埋没しない独立の見地から,政策決定の是非を判断する評価軸を提供しうる。そのような評価軸は問題の発見を促す契機となる。そしてそれはまた,議会,行政庁,裁判所,学界,一般公衆など,法形成過程に関与する様々なアクターの間で有意義な対話を促進する触媒となるのである。最後に,第I部から第III部までの考察をまとめるとともに,残された課題を明らかにして,本稿の結語とした。
