项目摘要

平成19年度は,1.政治的責務を正当化する諸理論のうち,特に関係的責務論の定式化・検討・2.国民が政治的責務を負う国家が健全に作動するために必要な統治機構の条件の検討,3.複合国境論の理論的彫琢を行った。1.現在有力に主張されてきている関係的責務論(国民の国家に対する責務を国民と国家の間の特別な関係によって正当化する議論)を,総体的・包括的に検討した。関係的責務論がアイデンティティ論,アナロジー論,共和主義論,ドゥオーキンの議論へと分解されることを示し,それぞれの議論を明確に定式化した上で,意義を確認しつつ批判する論考を執筆した『法学雑誌』54巻1号(2007.8),54巻2号(2007.11)掲載)。また,難解さをもって知られるドゥオーキンの関係的責務論を徹底的に分析し,それがアリストテレスではなくカントの友愛論に依拠していることを指摘し,結局関係的責務論とは異なる議論へと解体されるとする研究報告を行った(2007.8第23回IVR(法哲学、社会哲学国際学会連合)世界大会於ヤギェヴォ大学)。2.国民が政治的責務を負う国家が健全に作動するための統治機構の条件として,権力分立論について原理的な考察を行った(「権力分立原理は国家権力を実効的に統御しうるか」井上達夫他編『岩波講座憲法第1巻』(岩波書店,2007.4所収)。この研究は,国家の分立を国際秩序の基本的機制とする複合国境論にとって,示唆するところが極めて大である。3.複合国境論の理論的彫琢に向けた基礎作業を行った。ある課題を解決するための便法として国境が引かれること,その意味で国家とは解答による統合ではなく課題による統合であること,課題が複数ある場合には複数の国境が引かれるべき合理性があること,国境の複数性が抱える調整問題に対応するために国境の単数性への動因が内在していることを確認した。
