项目摘要

児童虐待や親の責任の懈怠など、現代親権法がかかえる課題は、単に民法の中の親権の規定を充実させさえすれば十分に図られるというわけではない。それらの諸問題を有効に解決するためには、子の利益あるいは権利の保護を現実化するための手続や児童福祉行政の整備、そして何よりもそれら諸機関を効率よく機能させるための調整機関の存在が不可欠である。本研究では、ドイツのミュンヘン市の連携システムの調査を通して、連携システムの中心には、諸種のサービスを通じて子およびその家族と近いところに立ちうる児童福祉当局を置き、必要に応じて司法作用を喚起できるという態勢が有用であることが確認できた。ミュンヘン市の調査では、児童福祉当局である少年局と家庭裁判所が、手続の開始や終了、意見聴取や職権調査、支援契約の策定、父母間の合意形成援助などについて、協定書を作成し、それに基づいて緊密な協力体制を敷いているほか、裁判所の仮命令を活用した、子の福祉の危険に対する迅速な対応の体制も整備されていた。いわゆる縦割り型の職務ではなかなか迅速かつ十分な対応ができかねるところ、多くの専門職との連携も交えて、異職種横断的で一体的な対応が重要であることを再認識することができた。
