项目摘要

(1)大正期における天然記念物制度発足の前後及び先立つ明治期の旧狩猟法制定時の立法議論に関する文献調査を通じ、従来は積極的な評価がされていなかった19世紀後半から20世紀初頭の自然保護法制度には、人と自然との文化的関係性を考えるにあたって、参考となるものがあることがわかった。特に天然記念物制度には、科学に立脚した普遍的要素と、地域に立脚した多様性・個別性の二面の要素があり、自然科学だけではなく、自然の文化的、社会的価値も包含できる制度であることが読み取れた。また、旧狩猟法は近代日本最古の自然保護法制度であるが、野生動物を利用した伝統的な生業、それもコモンズ的な資源管理を行ってきたものを近代土地所有権の下でどのように矛盾なく存続させうるかが焦点となり、文化的・社会的関係性を断ち切らない制度が選択されたことがわかった。(2)兵庫県豊岡、沖縄県名護及びやんばるといった天然記念物指定動物の生息地や、東日本の伝統的狩猟が残る山村におけるフィールドワークを通じ、自然保護法制には、従来重視されてきた普遍的な科学的価値だけではなく、地域に根差した個別性を認める多様性、または曖昧さが必要であることが確認された。天然記念物制度に関しては、従来欠点とされた指定基準の不明確さは、むしろ多様な地域性を取り入れた「曖昧さ」として積極的に評価しうる。即ち、上からの普遍性・科学性に基づく指定に加え、地域からの下からの指定が可能な制度の良さである。この長所は、ひいては地域おこしにも連結することも確認された。また、狩猟法制についても適度に利用して保存するといった関係が民俗知として存在しており、それを制度的に取り込むのには、地域性を認め、地域中間集団の活用などの非画一的な対応が必要であるとの結論に達した。
