本研究は、公法学及び政治学の領域において昨今きわめて注目されている討議民主主義(deliberative democracy)理論に基づき、裁判員制度の意義を再構成しようとするものである。研究の結果、この制度は、国民が刑事事件の裁判という公共的な事項について、検討し、決定するという公共的討議の場を創設するものだといえることを論証し、そして、それを通じて国民の公民的徳性(civic virtue)を涵養することを、制度導入のもう1つの意義として挙げることができることが判明した。
