本研究は、ドイツの環境保護法制に着目し、環境賦課金という「環境保全の新たな手法」を研究対象として、その実施に伴って生じる諸問題、特に法理論的課題について研究しようとするものである。本研究では、ドイツの排水賦課金制度について、(1)その導入の背景に「原因者負担原則」の実践および水管理法上の規制的手法の実効性の向上という意図があったことを明らかにし、その上で、(2)排水賦課金と水管理法との関係に焦点を当てることにより、(3)環境賦課金という手法の今後の方向性について展望した。

This study is aimed at studying the legal system of environmental protection, environmental protection and new methods of environmental protection. It is aimed at studying the problems associated with the implementation of environmental protection and special law theory. This study focuses on: (1) the background of introduction, the implementation of the principle of causation, and the effectiveness of water management law;(2) the focus of the relationship between water management law and drainage tax;(3) the future orientation of environmental tax.
