我が国の立法過程は、議会主導ではなく、明らかに行政主導であり、また多くの立法事項は、その制定を行政機関に委任している。かかる議会機能の空洞化を克服するため、委任立法統制に向けた英国議会の法制度を研究し、我が国の議会改革に一定の示唆を得ることが本研究の目的である。2年間にわたる研究の結果、上記文脈における英国議会の法制度について、その史的展開と背景要因、さらに、現行制度枠組の内容を分析し、その問題点を明らかにした上で、我が国の法体系への再構築する可能性を高めることができた。
