ここでは、比較法研究の基礎作業として、主にドイツ法及び英米法の検討を行い、具体的には、次のような作業を主として行った。まずドイツについては、ドイツ知的財産訴訟における営業秘密の保護のために検討すべき問題点につき、憲法上の裁判を受ける権利ないし法的審問請求権という観点から分析を試みた。特に、ドイツにおける法的審問請求権との関係での議論は参考になるものであったが、法的審問請求権として保障されなければいけない、ぎりぎりの外延というものがどこまでなのか、法的審問請求権とその他の対立利益(訴訟での権利実現等)との優劣関係をいかに解すべきかなどについてはなお研究の継続が必要であり、これがひいてはあるべき営業秘密の保護制度に密接に関連するものと現段階では考えている。米国・英国については、調査した範囲では、そのような根源的な議論が意識的にはあまりなされておらず、プロテクティヴ・オーダーに関するプラグマティックな議論が中心になされている点で、本研究の目的との関係では難しい点がある。もう少し視点を広げて、英米法固有の伝統的な法意識という視点から見た場合には、何らかの意義が見出せるように思われるが、この点もなお残された課題であるといえる。上記各作業については、上述のようになお解明すべき点が多く残されており、論文等の形で成果を公表するには至っていないが、次年度以降引き続き研究を進め、成果の公表につなげたいと考えている。
