平成30年度は、比例原則論との対比において、違憲審査基準論には、厳格度の異なる複数の審査基準を用いる点、及び、論証責任の分配を問題とする点などに特色があることに着目した上で、違憲審査基準の構成要素を分析的に解明し、手段審査における「より制限的でない代替手段」（LRA）の法理の判断構造を明確化することを通じて、違憲審査基準論における利益衡量の位置づけを考察した。この成果は、博士論文「違憲審査基準論の構造分析――違憲審査基準の『構成要素』という視点から――」として、京都大学法学研究科に提出した。具体的にいえば、日本とアメリカにおける学説・判例の分析を基に、訴訟法その他の法分野に関する知見を用いつつ、手段審査の構成要素を「狭義の関連性」審査と「相当性」審査に整理した。そして、利益衡量を行う「相当性」審査の中にLRAの法理を位置づけることで、「相当性」審査を、問題となっている法律内在的に目的実現度と制約強度を比較する場合、及び、問題となっている法律と代替手段における目的実現度の差異と制約強度の差異を比較する場合に区別した上で、経済学的知見を応用して、後者の場合における判断構造のモデル化を行った。このように、本年度は、日本とアメリカにおける単なる比較研究に留まらず、訴訟法その他の法分野に関する知見や経済学的知見をも活用しつつ、違憲審査基準論における基礎概念の定義をし、それらの相互関係を整理した。この点で、本研究は、違憲審査基準論における利益衡量の位置づけを明らかにするのに非常に意義のある研究だといえる。また、違憲審査基準の適用段階に焦点を当てた研究があまり見られない現状において、本研究は、違憲審査基準の適用方法を体系的に示し、実際の裁判において訴訟当事者が立法事実を踏まえて行うべき論証活動に対する指針を提示するものであり、実務的な影響の点でも重要性を有しているといえよう。
