1、本年度は前年度および前々年度において残された課題について、まず補充的な研究を行った。(1)中世の朝廷裁判において重要な役割を果たした検非違使について、基本的な文献を渉猟し、その裁判管轄と機能・役割を最近の研究成果等に基づいて確認した。また伊勢神宮の祭祀裁判についても、基礎的な研究と史料を収集し、その裁判の有り様についての実態分析を行った。(2)鎌倉幕府の奉行人については、政所奉行人、問注奉行人、侍所奉行人、引付奉行人等について分析を行い、機関の総括責任者や管理的職務に携わる者を含めて広くその機関に所属する者全体について奉行人として捉える広義の概念と、それらの機関の実務担当者、下僚的性格を有する者のみを限定して捉える狭義の概念が存在することを明らかにした。また地奉行人、保奉行人、賦奉行人、越訴奉行大等についても考察を加え、地奉行人および保奉行人は政所奉行人の、賦奉行人は問注奉行人の、越訴奉行人は引付奉行人の形態の一種と考え得ることを明らかにし、地奉行人および保奉行人は土地・道路管理や検断をはじめ様々な一般行政に携わっていたのであり、法曹官僚として位置づけるのは困難であるのに対して、賦奉行人および越訴奉行人は、訴状の配布や再審の審理という裁判実務を実質的に担っており、法曹官僚の一員として位置づけ得るべきことを明確にした。(3)近世金沢藩の公事場与力について考察する前提として、『加賀藩史料』における公事場に係わる記述を全てピックアップする作業を行った。その結果、当時の刑事裁判に関する記述を中心としてファイル6冊分の史料を得ることができ、その整理と分析を行った。2、以上の課題について分析検討を進めていく中で、最初に仮説として提示した一体型の法曹と分離型の法曹という形での前近代日本における法律実務集団の類型化が、中世の奉行人を含めて妥当し得るのではないかという見通しを得ることができた。
