项目摘要

本年度は死因調査に関する法的仕組みの構造的な把握を進めた。このことは死因調査に関する情報が法医解剖情報のデータベース化等により利活用されるための前提となる理論的基礎を提示することに資するものである。具体的には、死体解剖保存法や刑事訴訟法などに基づく各種の解剖・検視・検案が、行政各部においていかなる目的のもとにどのような仕組みをもって運用されているかについて整理・検討するとともに、現行法制度の形成に至る歴史的な経緯について調査した。明治期の刑法制定過程と現代の法医学につながる裁判医学の成立過程の関係からは国家による死因調査の対外的な要請も垣間見られ、また昭和の初期においては医学教育研究の進展に伴う死体解剖の構造的な変革を伴った社会的要請が行政による死因調査に大きくのしかかってきていたのではないかという仮説を持つにいたった。これら史的調査によって浮かび上がってきた課題をここに集約すれば、「なぜ行政が死因調査を担うのか」という観点からの再検討の必要性であり、かつ、この議論の成熟化の要請である。とくに第二次大戦後、検視規則と死体取扱規則によってある種の整理をみたと考えられた行政上の死因調査の枠組みも、その根源的な目的についての議論の成熟化をみないままになされたと考えられるふしがあり、そうしたことが司法検視と行政検視の後付けによる振り分け等、現行制度に内在的な問題を生じさせている一因であると考えられた。こんにちの死因調査法制の整備にあたっては、行政による死因調査の目的に対する議論の成熟化がより一層求められるものと考えるが、本研究はそうした議論の一助となるものと思われる。
