Research on the legislative history of the law concerning the organization of the justice

本研究厘清了有关司法组织的法律立法史(1890年)，并指出以下几点。该法律的初稿是由德国法官奥托·鲁道夫撰写的。在一次不平等条约修订会议上提交了第一份英文正式草案。它受到德国法律(1877年)的影响，但与德国法律不同的是，它采用了统一和集中的制度。这项法律旨在确立司法系统的独立性。

This research clarified the legislative history of law concerning the organization of the justice (1890) and pointed out the followings. The first draft of the law was written by Otto Rudorff, German judge. The first official draft written in English was presented in a conference for the unequal treaty revision. It was under the influence of the German law (1877), however, unlike the German law, it had adopted a unified and centralized system. The law aimed to establish the independence of the judicial system.
