本研究は、親が離婚した子の利益の保護という課題について、親子・家族関係の再構築プロセスの動態的把握という観点から、親の離婚後における再婚も射程におさめて取り組むものである。特に、ステップファミリー(子連れ再婚家族)における継親子の法的関係について、養子縁組の他にその規律を担う新たな法制度を創設する必要性を捉え、その提案のための基礎作業を進めてきた。1 本研究の最終年度にあたる本年度は、前年度に実施したステップファミリー当事者を対象としたインタビュー調査の収集データの整理・分析を進め、特に継親子の養子縁組に焦点を当てた検討の成果をまとめて論文を刊行した。「継親子が養子縁組を結ぶ/結ばない」とはどのようなことか、その決断や状況作出に至る経緯を詳細に見ながら、養子縁組が実際の当事者にとって持つ意味について考察を加えたものである。特に「継親子が養子縁組を結ばないこと」自体に焦点を当てた研究はこれまでに類を見ないものであり、養子法では対応しきれない継親子の多様な実情を描くことによって、法制私案作成を目指す上で有意義な基礎を築くことができたと考える。その他の調査データの検討の成果に関しても論文を作成中であり、その刊行をもって作業のひとまずの区切りを見る予定である。2 実態調査と並ぶ基礎作業の柱となる、継親子法制の比較法研究についても、英国法研究に本格的に着手した。実態調査で把握した、継親子当事者の多様な実態の尊重という要請に応答する観点から、養子縁組以外の多様な制度枠組みを擁する英国の継親子法制について、法制設計の手がかりを求めながら検討している。本年度は英国家族法の概説書及び主要論文集の精読を中心に作業を進めた。3 更に、離婚後の子の監護法制それ自体に関する研究も、これまでの豪州法における離婚後の共同養育法制の研究の成果に最新の知見を加えて、学会報告を行った。
