本研究は担保制度を横断的に比較検討し、譲渡担保の実行手続整備に活かすこと目的とする。今研究期間の研究内容は以下である。第一に、現代過去の質制度全般や集合動産譲渡担保を主とするABLに関して、昨年度に引き続き、ヒアリングを取り入れ、研究を進展させた。第二に、昨年から対象を拡大してヒアリングをした(具体的には、質屋古物商、銀行、自動車メーカー、法律職関係者等。謝金は先方の意向により予算執行なし)。またABLに関する第一線の研究者により開催された早稲田大学のGCOE研究会に参加し、知見を深めた。第三に、前年度に引き続き、主にフランス営業質、動産質研究を深化させている。研究成果は本研究機関の研究会で、本研究と専門領域が近い近江幸治教授(早稲田大学)を招き、行われた(博十論文完成間近の大学院生の専門に近い他大研究者から指導を受けるGCOEプログラムの一環)。主だった研究成果は以下である。集合動産譲渡担保(またABL)に関しては、最近の判例によりその重複設定が可能とされるものの、手続・公示の不十分さが壁となり、議論が進んでいないが、旧商法典商事質の運用は現況と類似しており、過去の制度を参考として現行制度下でのその制度設計の可能性を示しつつ、その限界も指摘した。また担保目的物と処分先の拡大が急務だが、これについて古物処分について高度な専門性をもつ質屋・古物商の活用という新たな可能性を示した。以上の通り、動産譲渡担保重複設定に関する問題の解決可能性や実行に関する方向性を示すことができ、研究完成は目前に達した。
