项目摘要

本年度は、1. 意思決定の前提となる自律概念の考察、2. 適切な自律的意思決定とインフォームド・コンセントの要件の検討、3. 従来の意思決定の枠組みの分析と患者の最善の利益の考察、4. 適切な意思決定プロセスに寄与する具体的フォームの検討という4つの側面から研究を遂行した。具体的には、1については、特に従来の生命倫理学における自律概念や近年の実践的自律概念に関する文献研究を通して、臨床の文脈に即した自律概念を考察した。これにより、意思決定において感情的影響は、単に制御すべき要素ではなく、重要な基礎となりうるものであることを明らかにした。次に2については、先行研究の議論をサーベイするとともに、医療・介護従事者らとの研究会に継続的に参加し意見交換を行うことを通して、自律的意思決定の要件を精査した。このことから、熟考された一貫した価値に基づく選択だけでなく、ある程度の安定性をもつ感情的態度に基づく選択も自律的意思決定として尊重される必要があることを示した。これは、臨床に即した適切な意思決定の要件を考察するための重要な観点となる。この研究成果をとりまとめ、学会および文系研究者・医療介護従事者などが参加する研究会での口頭発表を行った。また3については、従来の意思決定の枠組みに関する議論を分析することで、最善の利益に関して、患者の意向と体的利益-負担評価との均衡を慎重に捉えつつ、主観的QOL評価を重視する必要があることを明らかにした。さらに4については、上記1、2、3の研究成果をふまえるとともに、医療・介護従事者や患者・家族などが参加する研究会などでの意見交換を継続的に行うことで、具体的な場面で活用しうる事前指示フォームとその作成に至るまでの話し合いのための意思決定フォームの内容を検討し、医療・介護従事者らとの研究会で口頭発表した。
