Ideal Relationships of Victims and Criminal Justice Processes from a Perspective of "Kokuso"(Criminal Complaint) and "Shinkoku-zai"(Offence Prosecuted only upon a Criminal Complaint)

本研究从“刑事诉讼”和“新诉讼”的角度审视了受害者与刑事司法程序的理想关系。它们是有意尊重受害者意愿的系统。因此，在以受害者为中心的现行刑事政策下，“国男”和“新国仔”应该受到重视。本研究从比较与历史的法理学角度，检视1)警察与检察官对“新国载”受害者的理想回应；2)国保权的滥用与法律回应；3)国保的实质代理制度与受害者支援哲学等。

This study reviews ideal relationships of victims and criminal justice processes from a perspective of "Kokuso"(criminal complaint) and "Shinkoku-zai"(offence prosecuted only upon a criminal complaint). They are the systems that intend to respect intentions of victims. Therefore, under current criminal policy that emphasizes on victims, Kokuso and Shinkoku-zai should be received a lot of attention. This study reviews 1) ideal responses of police officers and prosecutors to victims of Shinkoku-zai, 2) abuses of the right of Kokuso and legal responses to them, 3) the system of Kokuso of agency in fact and the philosophy of victim support, among others, in comparative and historical jurisprudence perspectives.
