The Possibilities and the Limitation of "Facilitating Law"in Contemporary Society--- Establishing a legal framework which supports decision-making by themselves

在这个项目中，我一直在研究一个法律框架，在这个框架中，精神残疾者的自决权可以进一步得到加强。在这种“辅助决策”的法律制度下，预计在自己作出决定方面有困难的人可以得到其他人（即监护人）的充分支持，这些人也得到“便利法”的支持（例如给予保护，使其免于承担过多的责任）。在整个项目中，对日本法律中的“最佳利益”概念进行了非常详细的分析，特别是与英国2005年的《精神能力法案》进行了比较。希望通过这个项目，社会对个人“愿望”重要性的认识得到提高，无论他/她的精神能力有多有限。

In this project I have been researching on a legal framework where the right of people with mental disabilities to self-determination could be further enhanced. In such a legal system of “supported decision-making”, it will be expected that people who have difficulties in deciding by themselves could have sufficient support from others (i.e. guardians) who are also supported by “facilitating law” (e.g. giving protection from excessive liabilities). Throughout this project the concept of “best interest” in Japanese law has been analyzed in great detail, particularly as compared with the UK’s Mental Capacity Act 2005, It is to be hoped that social awareness of the importance of “wishes” of the person, no matter how limited his/her mental capacity would be, has been increased by this project.
