I confirmed that distinction between content-based and content-neutral regulations is founded not only on principle, but also on institutional factors by re-examining its doctrinal basis. If the institutional factors are important, we can mitigate rigidity of the distinction through their empirical analysis. Based on this analysis, our Court should not think the distinction too rigid, and conduct appropriate scrutiny for content-neutral regulations.

我确认，内容为基础的和内容中立的法规之间的区别，不仅是建立在原则上，但也在制度因素，通过重新审查其理论基础。如果制度因素是重要的，我们可以通过他们的实证分析来减轻这种区分的刚性。基于这一分析，我国法院不应认为这种区分过于僵化，而应对内容中立的规定进行适当的审查。
