项目摘要
The purpose of this research is to justify the injured party's claim to recover expenditures as damages in the case of breach of contract in Japan. To achieve this purpose, I compared the German law with the Japanese law. I tried to keep abreast of literature on the German civil code Art. 284 and analyzed the cases issued after the reform of the law of obligations in 2002.Especially my research focused on the problem whether the injured party can have a remedy to recover expenditures in addition to usual remedies of expectation damages, when the contract is terminated because of breaches.
这项研究的目的是在日本违约的情况下,证明受害方要求作为损害赔偿的支出是合理的。为了达到这一目的,我将德国法律与日本法律进行了比较。笔者试图了解德国民法典第284条的相关文献,并对2002年债法改革后出现的案例进行分析,特别是研究的重点是,当合同因违约而终止时,受害方是否可以在通常的期待损害赔偿救济之外获得追偿费用的救济。
