Socio-anthropological study of communality in the perspective of an joining phase of law and customs in norh-western Madagascar

在马达加斯加西北部，一个村庄的马达加斯加共和国法律和习惯公约的形成经历了三个历史阶段，即伊梅里纳王国统治时期、法国殖民统治时期和马达加斯加共和国统治时期，特别是在地方行政制度方面。一方面，一个村庄的习惯社会秩序不仅是通过参与公共工作和村庄集会的经历形成的，而且是通过养牛、使用斧头或训练战斗的方式形成的，所以这些经历都是有形的。在这一领域，存在着人们的非法惩罚，即所谓的“人民的判断”。然而，警察不敢干预这些问题。在这名警察不干涉的社会背景中，有警察本人对民众关于习惯社会秩序的共同共识的同情和认同。

In north-western Madagascar,Malagasy Republic's laws and customary conventions in a village are formed through three historical phases such as the period of Imerina kingdom's ruling,the period of French colonial ruling, and the period of Mlagasy Republic's ruling especially concerning the system of local administrations.On one side,the customary social order in a village are formed not only through experineces of participations to communal workings and village's assemblies but through cattle breeding or handling of hatchet or training forms of fighting,and so these experiences are physically embodied.In this area, there are people's illegal punishments so called "people's judgement".However,the police don't dare to intervene in these problems.In the soial background of this police's noninterveniton,there are police himself's sympathy and agreement on the poeple's communal consensus concerning the customary social order.
