本研究の課題は、外国人の一時的受け入れ政策と非正規滞在者の強制送還政策という一体的に運用される二つの政策は、(i.)いかなる規範的制約に服するべきなのだろうか、(ii.)その規範的制約のもとでは、どのような施策が許容され、どのような施策が制限されるのだろうか、(iii.)特に日本においては、どのような施策が許容されどのような施策が制限されるのだろうか、という三つの問いの探求である。第4年目である2023年度では、(i.)と(ii.)に関して、非正規滞在に関して、入管の許可なく暮らすことはそもそも悪いのかという問いを考察した。この論点はJ・カレンズの国境開放論にかかわるが現実の国家でなされる入管法の執行のされ方については論じられていない。本研究は、刑事政策学および行政法の知見もふまえ、制裁としての入管収容は廃止されるべきことと、許可なく暮らす人びとを「不法」と名指すべきではないと考えられる論拠を考察した。(iii.)に関しては、技能実習生の妊娠に焦点をあて研究した。技能実習で来日した女性が妊娠により悲劇的な事態に直面することは少なくない。2020年11月に熊本の技能実習生女性が自宅で双子の赤ちゃんを死産し自宅の棚に安置したことが死体遺棄罪に問われた事件が広く報道されたことは記憶に新しい。日本の法令を念頭に置いた場合には、男女雇用機会均等法では妊娠・出産等を理由とした不利益取扱いは禁止されているため、彼女が妊娠を隠さねばならなかった理由は理解することは難しい。この問題を理解するためは、法令だけからは捉えることができない構造的不正義に着目する必要がある。そのため、I・ヤングが1990年までに発表した身体と無意識のバイアスについての論考、とアメリカの入国管理政策に関する2020年のA・リード＝サンドバルの論考に着目しつつ背景にある構造的不正義を明らかにする研究を行った。
