Research on the Private International Law in East Asia: Recent Developments and Possibility of Harmonization

本研究项目旨在通过比较法分析，揭示近年来东亚各国国际私法立法发生巨大变化的异同。研究项目还提出了在法律上进行协调的可能性。作为研究的结果，本文对中国国际私法进行了综述，并对其总则、财产法和家庭法进行了评析。但是，日本、中国和韩国通过对法律选择规则、实体法和国际诉讼法的比较法分析，讨论了处理国际家庭问题的协调可能性，并提出了包括离婚管辖权平等化和放宽互惠条件在内的具体方案。

This research project aims to reveal by means of comparative law analysis the similarities and differences in the Private International Laws among East Asia countries where dramatic changes in the legislation have occurred in recent years. Also the research project proposes to explore the possibility of harmonization in the law.As the results of the research, a survey on the Private International Law of China and commentaries on its general provisions, property and family law have been made. Nonetheless, the possibility of harmonization in dealing with international family matters has been discussed after a comparative law analysis on rules of choice of law, substantive law and International Procedure Law among Japan, China and Korea, where a specific plan including the equalization of divorce jurisdiction and the relaxation of reciprocity requirement is proposed.
