项目摘要

初年度は、米国商標法における希釈化（ダイリューション）規制の基本構造および正当化根拠を中心に研究を進めた。米国における希釈化規制の起源は、1927年に公表されたFrank Schechterの論文「The Rational Basis of Trademark Protection」にまで遡ることができると一般的に説明されてきた。ところが、Barton Beebeの最新の論文によれば、Schechterは希釈化法理を正当化するためにドイツのOdol判決を参照する際に、他者の労働の成果を不正に使用する行為は善良な道徳に反する旨を判示した同判決の重要な箇所を意図的に省略することにより、ミスアプロプリエーション法理を採用した1918年のINS最高裁判決と自らの主張を切り離すことを意図していた可能性があると指摘されている。本年度の研究では、Beebe論文をはじめとする近時の学説を手掛かりに、Schechterの見解は、ミスアプロプリエーション法理に端を発する現行法の希釈化類型（「blurring」及び「Tarnishment」）とは直接的な関連性を有していないと結論した。日本法における希釈化規制（不競法2条1項2号）を論じる際にも米国の伝統的な見解が参照されることが少なくないため、近時の議論の展開は一定の影響を有するといえよう。

At the beginning of the year, the Trademark Law of the United States and the United States Trademark Law established a basic framework for the study of the root cause of justification. In the United States, the origin of the standard standard was established. In 1927, the Frank Schechter document "The Rational Basis of Trademark Protection" was published in the public table. The Japanese law intends to standardize the regulations (Article 2, Article 1, item 2). In the context of the United States system of the United States, reference is made to the introduction of the International Economic and Cultural system, and the opening of the recent talks must have an impact.
