本年度は、著作権に関する権利制限規定と3 step testの関係について研究を行った。本研究は、我が国著作権法学における伝統的な見解である権利制限規定の厳格解釈論を、3 step testの観点から批判的に考察したものである。具体的には、条約加盟国が著作権の制限を設けることができる範囲を定める条約上の義務である3 step test (TRIPs協定13条等)の解釈に関して、同テストを文言通りに厳格に解釈し、権利制限の認められる範囲を限定的に捉える伝統的な考え方を批判し、条約の目的・原則規定や関連する他の条約の規定との関係を考慮した柔軟な解釈を提唱する。以上の結論を導くために、第1に、1967年にベルヌ条約に同テストが初めて規定されてから現在に至るまでの発展を歴史的に辿ることにより、国際条約の交渉において権利者よりのバイアスが生じる構造的要因があることを指摘した。第2に、これまでWTO紛争解決機関が同テストを解釈した際には、同機関は各国の立法の背後にある政策目的を十分に吟味することなく、条約規定をその文言に忠実に解釈するという解釈アプローチが採用されることが多いため、条約規定の文言に内在する権利者よりの性質がそのまま条約規定の解釈に反映されてしまい、結果的に、権利者よりの結論が導かれる傾向が高くなっていることを明らかにした。また、WTO紛争解決制度の問題点として、本来ユーザーの利益を代表するはずの開発途上国やNGOの参加が認められにくい構造が事実上存在していることを指摘し、アミカス・ブリーフの拡充や第三国参加を促すなどのリフォームを行うことが、権利者寄りのバイアスがかかった解釈がなされるという問題に対する解決策の一つになり得る可能性があることを指摘した。以上の研究成果は、本年3月に提出された博士論文にまとめられており、また、学術雑誌に連載を行っている途中である。
