项目摘要

本年度は、昨年度（平成28年度）の研究実績報告書において掲げた以下の「今後の研究の推進方策」にしたがって研究を進めた。（1）オッペンハイムの合意主義理論について、彼の概説書・諸論稿間の記述の異同を示し、その理由を解明する。（2）オッペンハイムの国際法理論が、特に19世紀末のドイツ国際法論（とりわけイェリネク（G. Jellinek）やトリーペル（H. Triepel）のそれ）をどのような形で受容したものであるかを明らかにする。（3）オッペンハイム以後の合意主義理論の「公理」化の過程を明らかにする。以上の3点について、本年度の具体的な研究実施状況は次の通りである。まず（1）については、オッペンハイムの概説書初版第1巻（1905年）における「共通の同意」（common consent）を中心とする国際法の基礎・法源論と、1915年に公表された「慣習国際法論」における議論とを比較対照することで、両著作における議論の整合性に関する検討・分析を試みた。次に（2）については、オッペンハイムの概説書というテクストの形成に着目して、オッペンハイムにおける国際法の基礎・法源論が同時代の諸研究とどのような関係に立つものであるのかを分析した。最後に（3）については、戦間期における国際法の概説書を、オッペンハイムの国際法論の後の受容という観点から分析した。なお、以上の研究成果の一部を九州国際法学会例会（於西南学院大学）にて報告し、フィードバックを得た上で、最終的には博士学位請求論文「国際法学説史における合意主義理論の構造と展開――オッペンハイムの共通の同意論をめぐって」として纏め上げた。
