项目摘要

本研究は、研究対象となる時期を【Ⅰ】近代国際法完成期（1776～1914年）、【Ⅱ】戦間期（1915～1945年）に分類し、それぞれの時期における自然国際法論の代表的著作の検討を通して自然国際法論の展開史を解明し、【Ⅲ】両者の関係を整理した上で、同時代における一般法史学における「自然法の再生」との比較検討を行うことで、自然法論に関する国際法史研究と一般法史学研究との接合を目指すものである。研究期間の3年目に当たる本年度は、昨年度に引き続き、第一次世界大戦後の新たな国際法思想の潮流の一つとしての自然国際法論の「再生」に着目し、この担い手となった諸著作の検討・分析を行った。より具体的に言えば、第一次世界大戦後のドイツにおいて設立され、カトリック法学者によって構成された「キリスト教国際法のための委員会」の議論の成果物として刊行された叢書について、昨年度に渉猟したものを分析することで、戦間期という時代にどのような自然国際法論が提唱されたのかという点を解明した。この叢書の存在は国内外の先行研究において看過されてきたものであり、これらを発見し検討の対象とすることじたいに研究上の意義があることは言うまでもない。さらに、これらの分析を下敷きにして、戦間期の日本の国際法学において展開された自然法論を詳細に検討した。検討対象となったのは、田中耕太郎と大澤章の著作・論稿である。カトリック法学者であった2人は、同時代の（とりわけ）欧州の自然法論をそれぞれ分析し、日本の国際法学界に紹介したという点において、日本の国際法学における一定の貢献をなした。これらの貢献の具体的な学術的意義については、今年度の研究対象である。

During the three years of research, the current year, the previous year, the first world congress, the new trend of international law thought, the "regeneration" of natural international law theory, the discussion and analysis of various works, The results of the discussion on the "Committee for the Teaching of International Law" after the First World Congress were published in the series of articles on the analysis of international law in the past year. The existence of this series has been studied in advance at home and abroad. This paper discusses the theory of natural law in detail.
