项目摘要

本年度は、修士論文を書き直し、『国家学会雑誌』に公表した。この論文「外交的保護の法的構造――国家責任法論の再構成のために――」(国家学会雑誌131巻7・8号)は、常設国際司法裁判所(PCIJ)・国際司法裁判所(ICJ)による外交的保護(外国領域内の自国民が国際法上違法な待遇を受けたとき、国家が領域国の国際法上の責任を問うこと)の理解と、学説の通説的見解による外交的保護の理解が、全く異なったものであることを、主に論じた。特別研究員に応募する段階では、この論文をもう少し早く公表し、特別研究員に採用される3年間のあいだにこの論文を踏まえて研究をさらに進め、博士論文を完成させる予定であった。しかし実際には、このような予定どおり研究は進まず、この論文の書き直し、公表にかかる作業に予想以上の時間がかかってしまい、この論文の出版が、今年度の10月となってしまったため、今年度中の博士論文の提出は、断念せざるを得なかった。もっとも、この論文の公表に至る過程で、研究それ自体だけではなく、研究者としての能力を向上させることができたので、来年度中には、博士論文が提出できるのではないかと考えている博士論文は、仲裁実行における外交的保護について検討するなどして、外交的保護についての議論を拡充・強化するだけでなく、外交的保護以外の類型についても、冒頭にあげた論文で得られた視座から、分析し直すことによって、国家責任法全体の再構成を試みる予定である。
