项目摘要

研究[アメリカ反トラスト法と特許規制]は反トラスト法に基づく訴訟の結果、企業が独占的に保持していた特許・技術が他社に対して特許許諾実施するようになった事実を考察するものである。許諾実施された特許にはトランジスタやカラーテレビ、またカラーフィルムなどの技術が含まれており、日本企業の成長に多大な影響を与えるものであった。とりわけ本研究では特許を強制実施させたアメリカ司法省に着目し、反トラスト法と特許、反トラスト法と企業との関係が分析するものである。本年度の特別研究費は関連図書の購入の他はアメリカでの資料調査費として使用された。公文書館〔NARA〕Ⅱが所蔵する司法省の資料には閲覧制限がかけられているため、昨年度に続き本年度も、司法省反トラスト局に在籍したデ・ラマーター文書を閲覧すべくハグレー・ミュージアムにて資料調査をおこなった。本年度の実績を具体的に言えば、次の事柄が確認できたことにある。1．1930年代に既に特許権が市場独占と深く結び付いているという認識を政府高官は有している。2.ところが憲法で保護された権利たる特許権を反トラスト法によって制限することは難しかった。3．この状況は第二次世界大戦期に特許ライセンス契約を悪用した国際カルテルが国防問題として注目され、司法省高官は特許を規制する必要性を強く記している。3．1940年代末から司法省は特許権を基礎にした市場独占の形成を阻止すべく反トラスト法訴訟を提訴した。4．しかし憲法で保護されている特許権をどこまで反トラスト法上規制すべきかという議論は議論されてきたが現在でも意見が分かれる問題であり、裁判所と言えども早々に判断できない。5．このため司法省は法的和解に強制力を持たせた形式でこれらの訴訟を終えると共に、新興市場の形成に資すると思われた特許・技術に関してはライセンス義務を企業に課したのであった。
