项目摘要

研究計画の6年目である令和4年度は、調査・収集を行うと共に、その途中の成果をまとめる予定であった。これまでの調査では、19世紀末から20世紀前半にかけての〈分離すれど平等〉原則の法思想史的連続性を探るため、合衆国における人種分離という制度・慣習を通史的に整理してきた。具体的には、合衆国の鉄道における人種隔離を調査対象とし、南北戦争以後から20世紀半ばにかけての合衆国南部に固有の現象だと思われていた人種分離は、ほぼ同じ形で南北戦争以前の北部においても存在しており、南北戦争以前の北部でも後年の南部と同じような、アフリカ系アメリカ人に対するレイシズムが比較的小規模であるものの存在していたこと、そして後年の南部では南北戦争以前の北部でよりも、厳密に人種間の差異を明確にする必要があったことを確認した。さらに、1830年後半から1840年代前半にかけてのマサチューセツの鉄道における人種分離の慣習とその撤廃運動に焦点を当てて、マサチューセツでは商業的鉄道が登場した初期から存在していた人種分離が廃止に追い込まれたのは、人種分離と奴隷制の間に連続性を見いだしていた奴隷制廃止論者たちの活躍のためであることを確認した。以上を踏まえて、令和4年度では、マサチューセツの鉄道における人種分離が、特殊な事態ではなく、他の人種分離の慣習の延長にあったこと、そして結局のところはその発生に繋がったレイシズムは奴隷制に端を発することを、当時の新聞記事、とりわけ、鉄道会社による人種分離の撤廃を訴えた奴隷制廃止論者のマサチューセツ議会の公聴会での議論の分析を中心に、論考としてまとめた。その結果、〈分離すれど平等〉原則を理解するためには、人種分離・レイシズム・奴隷制の影響の3点の相互関係を探ることが鍵になることを改めて確認するに至った。
