项目摘要

法が人間の主体性やコミュニケーション能力に与える影響について、ポストモダン法学的な視点からの研究を進めた。最初に、実際に起こった刑事事件の被告の言動を、文学的・芸術批評的な側面から分析し、カフカの『審判』などポストモダン的な法理論と関係付けた論考「カフカの『審判』から見た相模原殺傷事件：「掟の門」が示唆する「法」と「法外なもの」の境界線」（『金沢法学』65巻１号）を執筆し、この内容について、法哲学の研究者等と意見交換した。この論文で浮上した、「法」による他者排除作用の問題に関連して、カール・シュミットの『政治哲学』、ヴァルター・ベンヤミンの『暴力批判論』、アガンベンの『ホモ・サケル』、フーコーの生権力論を繋ぐ、「法」も持つ「正常＝規範性」の形成と、その裏面としての異質なるものの排除をテーマとした論考「シュミットの『政治神学』のポストモダン的な再考」（『金沢法学』65巻２号）を執筆した。この論文に関連して、2023年３月末に愛知大学で開催された「ポストマルクス主義研究会」で、「フーコーの生権力」論と題した報告を行い、同研究会に参加した経済思想史や法哲学の研究者等と、生権力の意味について意見交換した。また、論創社より刊行されている『定点観測　新型コロナウィルスと私たちの社会』シリーズの『2022年前半』及び『2022年後半』にそれぞれ寄稿し（「コロナ禍と哲学５」「コロナ禍と哲学６」）、新型コロナウィルスによって、シュミットやフーコーが問題にした、新たな「正常性」の形成とも言うべき事態が進行していること、それが安倍元首相の暗殺を機に浮上した、宗教と政治の関係、宗教を信じる人間の主体性、宗教を信じる人間に対する社会的評価の問題と深く関係している可能性があることを示唆した。
