2022年度の本研究は、憲法典と「実質的意味の憲法」との相互関係（後者が前者に優位するか内在するか等）や，解釈者の有する憲法理論が憲法典の解釈に作用する機序を明らかにすることを目的としていた。その主たる成果の第一としては、井上達夫による「憲法9条削除論」に対する批判的研究が挙げられる。井上によれば、同条は絶対平和主義を要請している規定であるにもかかわらず、その趣旨を具体的に実現しようとせず、同条に反する実態を追認する論者や、同条に反する自衛隊・日米安保体制を同条の許容するところと解する論者が不当にも「護憲派」と称して、同条の規範的意義を貶めている、とされる。しかし、井上のように同条をもっぱら絶対平和主義を要請するものと解するのは、あまりに狭隘な憲法解釈観だというほかない。憲法解釈は、解釈者の前提理解・世界観を基にしながら、憲法典全体との整合性が取れるように、憲法典条文の意味を明らかにする作用であって、同条文の「文字通り」の解釈のみが正当な憲法解釈とは直ちに言えないからである。2022年度の主たる成果の第二としては、日本国憲法は、その簡素・簡潔ぶりから、公権力に対する規制力を失っているので、その改正により規律密度を上げることが「立憲主義」に適うとする井上武史説ら一部学説を批判的に研究したものを挙げることができる。そもそも各国の憲法典の法秩序における位置づけが異なる以上、各国の憲法典の条文数だけを比較して、その規範的意義を明らかにすることはできない。また、憲法典条文からいかなる憲法規範が導出され、その解釈上導かれた憲法規範がどのように適用されているのかが重要なのであるから、憲法典から「実質的意味の憲法」というにふさわしい憲法規範を導きうる解釈方法論や制度的枠組みを検討するのが先決である、と主張した。
