项目摘要

わが国においては、高齢者人口が増加しているにもかかわらず、高齢者の財産管理制度である成年後見制度はあまり利用されていない。そこで、本研究は、高齢者や心身障害者（以下「高齢者等」という）の利用しやすい、かつ安全な財産管理制度の提言を研究目的とする。特に、本研究は、英米で高齢者等の財産管理の仕組みとして実績のある「信託」について、社会的弱者である高齢者等を受益者とする信託の保護機能を、より強化・充実させるために、受託者のガバナンスの再構築を目指すものであり、高齢化社会の進むわが国において社会的意義のある、かつ学術的な独自性が高い研究である。さらに、本研究の研究成果により、高齢者等の日常生活を支援する安全な財産管理制度が構築できれば、来るべき超高齢化社会をより暮らしやすい社会とすることができ、社会に対し多大な貢献のできる研究である。高齢者等の財産管理に資する信託の場合、将来の不確実な社会情勢や経済情勢を想定した詳細な信託条項を作成することは不可能なこともあり、広範な権限が財産管理主体に付与されるとともに、信託設定者の意思を実現するための柔軟な制度運用が求められる。また、高齢者等の財産管理は、「高齢者等の存命中」から、その者の死後に「財産を承継する者が、主体的に財産管理できる」までの長期にわたり行われる。そのため、高齢者等の財産管理を目的とする信託においては、①「誰」を、または「どのような法主体」を受託者とするべきか、②その者をどのように「監督」・「規制」すべきか（法人が受託者となる場合、どのような機関を設け、ガバナンスを行うか。個人が受託者となる場合、その者をどのように監督すべきか）、が課題となる。そこで、本研究では、上記①・②の課題について、具体的な仕組み、法制度を提言できるまで、明らかにすることを目的とする。
