本研究は、大日本帝国憲法の制定過程において、二院制度に基づく代表制がどのように整備され、それはいかなる特徴を有したのかについて、上院構想をめぐる展開を中心に検討するものである。2022年度は、本研究が憲法制定過程の「前期」と位置付ける伊藤博文が欧州での憲法調査から帰国する以前を対象とした。これにより明らかにした内容は、以下のように整理できる。この時期、日本国内の憲法制定作業において中心的役割を果たしたのが、右大臣・岩倉具視とその下で実際の調査に従事していた井上毅である。彼らは、特に上院制度を重視したが、その思想的背景をなしていたのが、当該期に進行していた2つの現象への危機感であった。すなわち、諸政党の並立に象徴的な「衆論」の分裂状況及びそれらと政府との乖離、経済力を背景とした新興勢力の（思想的あるいは精神的側面も含めた）強力化である。彼らはこれらを不可避の現象と認めつつも、それが将来の下院に反映されることを予想し、強く危惧した。こうした両者が上院に求めたのは、単に下院やそこを根拠とするであろう政党勢力への抑制機能のみではない。彼らが意図したのは、分裂した「衆論」に支配されるであろう下院やこうした分裂の背景ともなる経済的価値意識に抗し得る装置として上院を対置することであった。よって、当該期の上院構想における課題は、①「衆論」に対峙し得る「公論」（もちろん、何が「公論」たり得るかは主観的審級に基づくものであり、現実におけるそれは政府の方針と一致する志向性に近い）を担い、経済力とは異なる価値観を表象できる階層の創出、②下院が担うであろう「衆論」の代表という位置とは異なる正当性を上院に与えることに置かれた。これらはそれぞれ、①華族や士族に対する政策、②皇室との特殊な関係性を権限レベルで上院に付与しようとする動きとなって、大きな影響を与えていくのである。
