今年度は、「発達」という概念につき、「子どもの権利条約」を中心に考察した。そのうえで、2023年4月1日に施行された「こども基本法」や同日に設置された「こども家庭庁」にかかかる法的問題について考察した。近年、乳幼児期を中心に、発達心理学研究では「愛着(attachment)」への再評価がなされている。また、ヴィゴツキー心理学の観点から、発達を関係論的に考察する研究が進んでいる。このように、発達を個人のなかで完結したものではなく、他者（・大人）との関係の相においてとらえる見方は、教育法理論に極めて大きな意味を持つものである。個人の発達が他者（・大人）との関係においてこそ実現するものであるならば、子どもの発達の権利―子どもの権利条約6条には「生命・生存・発達の権利」が規定されている―は、必然的に発達を可能とする他者（・大人）との関係を子どもたちに保障することを要請する。愛着理論やヴィゴツキー的な関係論的な発達論は、従来の枠組みを超えて、教育法が切する範囲を大きく刷新する可能性をひめたものであると評価することができる。加えて、4月1日に施行された「こども基本法」や同日に設置された「こども家庭庁」は、その目的に「子どもの権利条約」を参照し、まさに、子どもの「生命・生存・発達の権利」を保障することを高らかに宣言している。「こども基本法」の運用や「こども家庭庁」の運営に関わり、今度どのような法による規律が可能であるかを、発達論の観点から教育条理を参照しながら検討することが求められる。
