いじめ防止対策推進法上、学校いじめ対策組織には、学校が組織的かつ実効的にいじめの問題に取り組むための中核的役割を担うことが期待されている。しかしながら、当該組織については定着の遅れが指摘されており、いじめ防止対策推進法が決別したはずの従来型のいじめ対応から脱却できていない可能性がある。こうした状況下で、学校いじめ対策組織を活用し、外部専門家との連携システムを構築することが喫緊の課題となっている。そこで本研究では、学校いじめ対策組織及び外部専門家を活用した、いじめ対応への効果的な組織的アプローチの在り方を検討することを目的としている。研究初年度である2022年度は、研究遂行のために必要な基礎データの収集を行った。具体的には、先行研究の収集・分析、及びいじめ防止対策推進法の立法過程に関する分析を実施すると共に、いじめに関する裁判例の収集に着手した。具体的には、先行研究の収集・分析の結果、①学校いじめ対策組織に着眼した学術的研究の蓄積は乏しい状況にあり、そえゆえ当該組織がどのような形で学校現場に定着してきているのか、その構成や運用の実態を明らかにすべきこと、②学校いじめ対策組織への外部専門家の活用を検討していく上では、外部専門家の「勤務形態」や「外部性の保持と内部性の獲得のバランス」等の論点を含める必要があることを明らかにした。また、国会会議録の分析を通じて立法過程を調査した結果、立法過程の議論では、学校いじめ対策組織は既存の組織・会議を活用することも可能とされており、平成25年10月11日に策定された「いじめの防止等のための基本的な方針」にも「既存の組織を活用して、法律に基づく組織としていじめの防止等の措置を実効的に行うべく機能させることも法の趣旨に合致する」という記載がなされていた。しかし、平成29年3月の改訂版では、この記述が削除され、方針の転換が見られた点は注目に値する。
