项目摘要

本年度の課題は、昨年度に引き続き各論点を個別的に分析し、ウェポンズ・ローの長い歴史における機能的変化の位置づけを体系的に明らかにし、及びウェポンズ・ローの機能的変化が武力紛争法全体の中でいかなる意義を有しているのかを分析することであった。結果は以下のとおりである。1．ウェポンズ・ローと相互主義及び軍縮措置：対人地雷禁止条約等のいわゆる「ハイブリッド条約」は、厳格な規制及び軍縮的措置等の導入により、従来のウェポンズ・ローとは異なる、相互主義を基盤としない条約義務の履行確保制度を確立させたが、それらが兵器使用禁止義務の履行を効果的に確保するものではないことを、昨年度中に明らかにした。他方で、ウェポンズ・ローの適用及び履行確保が、相互主義から完全に脱却していないことも明らかにした。本年度はこの分析結果を精査した上で、2014年度国際安全保障学会年次研究大会において研究報告を行った。また、分析結果を研究論文として公表した。2．ウェポンズ・ローと非国際的武力紛争：ウェポンズ・ローが非国際的武力紛争へ適用されるようになると、武力紛争法、国際人権法、及び国内法という、致死力の行使（兵器の使用）基準が異なる複数の法規範が重畳的に適用されるようになる。このような事態からいかなる問題が生じるのかについて、昨年度に引き続き分析を行ったが、本年度中に結論を導き出すことができなかった。分析を継続し、早急に研究成果を公表したいと考えている。3．ウェポンズ･ローの歴史における機能的変化の位置づけ、及び武力紛争法における機能的変化の意義：上記2と平行し、分析を行った。現時点では、ウェポンズ･ローの各機能変化は、人道的考慮、とりわけ文民保護の要請が拡大していることによって生じていると考えられる。本論点のさらなる分析は、今後の研究課題としたい。
