项目摘要

本研究は、民主主義と新自由主義への「二重の移行」後のラテンアメリカにおける、社会政策分野を中心とする利益代表構造の類型化と、そうした差異が形成された要因の解明を試みるものである。初年度はまず、関連する先行研究の検討を行った。この作業の中で、一国の利益代表構造全体を論じるためには、まずは具体的な政策について比較の観点から理論化を検討することがよさそうであるとの認識を持つに至った。そこで注目したのが、労働法制改革をめぐる政治である。本研究では、これまでのラテンアメリカ諸国の労働法制改革に関する研究・理論を踏まえつつ、比較の観点から政労関係レジームと労働法制改革の関連性を理論化することを現在試みている。この理論化の作業と並行して、具体的な事例としてまずメキシコについての考察を進めている。メキシコは、少なくとも法制上は、労働者を保護する内容の労働法制が強く維持された典型的な事例であるが、近年雇用の柔軟化を柱とする労働法制改革が実現した。新自由主義改革の渦中にあって長年労働法制が維持されてきたメキシコで、むしろラテンアメリカ全体の近年の傾向に逆行するかのように、ある程度規模の大きい労働規制緩和が行われたのはなぜか。この問いに対して本研究は、コーポラティスト型レジームが強く残った典型例であるメキシコで、新自由主義が継続的に採用されていく中で、同レジームが労働者個人にとってコストの大きい労働規制緩和をもたらしたという(一見逆説的な)仮説を検証していく。現段階は今後の実証研究のための予備的な考察の段階であるが、ある程度研究の具体的な方向性は定まってきたといえる。本研究はラテンアメリカ地域研究における新たな成果を期待できるだけでなく、利益代表構造の類型論や労働法制改革の比較・検討を通して、広く比較政治の理論発展にも寄与することを目指している。

This study aims to clarify the main causes of the formation of interest representation structure after the transition between democracy and neoliberalism. In the first half of the year, we conducted a preliminary study on the relationship between the two. The legal system reform is the focus of attention. This study aims at theorizing on the relationship between political and legal reforms in different countries.
