I am interested in the state practice of withholding the dead bodies of 'enemies' in order to use them for political gain. The use of enemy bodies who have been killed as 'hostages' is unaccounted for in international law and has received little attention within legal literature. Using numerous Supreme Court rulings from Israel as well as comparative legal sources, I aim to explore how the norms of international and domestic law govern (or fail to govern) 'posthumous hostage' taking, and, insofar as there is a legal lacuna, whether clear provisions of rights and obligations could be formulated.
