2022年度の研究実績としては、次の２点を挙げることができる。第１に、フランスの法制度や判例を中心に「私生活の尊重の権利」の概念を整理した。基本となるのは、「私生活の尊重の権利」を保障する民法典第９条である。これとともに、刑法典には、私生活侵害罪が設けられ、会話の録音、肖像の録画、住居侵入、通信の開示等が処罰の対象とされた。また、様々な監視措置が設けられており、犯罪捜査活動としての監視（司法傍受）、犯罪予防活動としての監視（行政傍受）、犯罪者処遇としての監視が制度化されている。プライバシーを保護するための独立行政機関も設けられ、「全国治安傍受監督委員会」（CNCIS）、「国家情報技術監視委員会」（CNCTR）、「情報処理および自由に関する全国委員会」（CNIL）が公的機関に対する監督を行っている。これらの法制度の実態は、法制化が不十分な日本の現状に再考を迫り得るものであると思われる。第２に、国家によるプライバシー権の保護の態様の一環として、近年活発に議論されている「忘れられる権利」について、フランス、ヨーロッパ、日本の議論を調査検討した。特に、検索エンジンが検索結果を公表することがプライバシー権を侵害することを理由に、検索結果の削除を認めることができるかどうかという点は、それぞれの法制度の下で裁判上の論点として争われてきた。フランスでは、「情報処理および自由に関する全国委員会」（CNIL）が徹底した個人情報の保護を図っており、その処分をめぐってＥＵ司法裁判所に紛争が持ち込まれることがある。総じて、ヨーロッパでは、個人情報の保護が徹底されているのに対し、日本では、検索エンジンによる検索結果の公表も表現行為として捉えられ、表現の自由との利益衡量によって判断される傾向にある。インターネット上からの親密で私的な情報を削除されることにより、国家や社会からの親密圏の回復が課題となる。
